Foreclosure of an Unauthorized Parking Lot in Fort Myers
For several years, the city of Fort Myers has accused Mr. Carmine Naccarato, owner of Key Estero Shops, of having an unauthorized parking lot on this property on Estero Boulevard. For this reason, the city began a foreclosure process on Mr. Naccarato’s property.
Monica Schmucker, the new magistrate of the city of Fort Myers Beach, determined that the accusations that had been presented for a long time regarding this property were valid, which allowed the city to proceed with these foreclosure actions on the parking lot.
On the other side was Mr. Naccarato, who attended the hearing without a lawyer and with very little preparation to defend himself against the accusations. In his attempt, he commented on his long history in the city of Fort Myers and expressed that the city government only wanted to harm him, labeling them as evil and corrupt people.
In its argument, the city claims that Naccarato has been operating an unauthorized parking lot for several years at 1661 Estero Boulevard, charging between $10 per day during the off-season and $30 per day for special events.
Previously, Lee County allowed property owners to rent out some spaces, and owners charged for parking in that lot without receiving any violations. Now the spaces in the Key Estero parking lot are intended for customers visiting the businesses in that plaza, and the city now has specific regulations that must be followed to operate a revenue-generating parking lot, regulations that Mr. Naccarato apparently was not willing to comply with.
If the city’s claims are correct, other parking businesses in Fort Myers Beach that have complied with the rules have lost tens of thousands of dollars by having to compete with Mr. Naccarato’s alleged unauthorized parking lot. For this reason, in 2020, the city issued Naccarato a notice of violation and ordered him to correct it by obtaining a special use permit, but he did not resolve the violation, which led to the accumulation of fines of about $220,000 and a lien on his property.
In addition to this, the city also accused Naccarato of selling parking spaces in the United States Post Office parking lot, located behind his property.
